1. ACCEPTANCE OF TERMS
Welcome to MoneyTracky. These Terms and Conditions of Use (hereinafter, the "Terms") constitute a binding legal agreement entered into between you as an individual or prosumer (hereinafter, the "User") and APPS PLUS AI S.A.S. (hereinafter, the "Company"), regarding the use of the MoneyTracky software, mobile application, and complementary services (the "Service" or "Application").
BY REGISTERING, INSTALLING, SIGNING IN WITH GOOGLE®, OR USING MONEYTRACKY, YOU DECLARE THAT YOU HAVE READ, UNDERSTOOD, AND ACCEPTED THESE TERMS IN THEIR ENTIRETY AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE WITH THESE TERMS, REFRAIN FROM USING THE SERVICE.
2. DEFINITIONS
The terms and definitions in these Terms of Use shall have the meanings specified below:
-
MoneyTracky: MoneyTracky (www.moneytracky.com) is an Application that, through data extraction from document images, allows users not only to track total income and expense amounts, but also to process the individual line items listed in them. Users can query these items and generate customized reports through the 'AI Query' feature using natural language instructions. Users can also view balance, income, and expense reports, as well as various charts such as cash flow, expenses by Category and Subcategory, and Expense Center. Currently, MoneyTracky has enabled data extraction models for documents from the United States of America and Colombia, supporting both English and Spanish. The Application does not permit manual entry of values or data for income or expenses.
-
User: The individual who enters into a Use Agreement for the Application using their personal Google® '@gmail.com' email account (for which the User is solely responsible for maintaining password confidentiality). Upon accessing the Application or website (www.moneytracky.com) for the first time, the User authorizes the collection of their email address, user name, and photo, and grants permissions to create a folder in Google Drive® where processed document files and other application-generated files will be stored.
-
Use Agreement: Refers to the license granted by the Company to the User to use the Application. This license is activated upon subscription to one of the plans offered in the Application and provides that:
- It is personal, limited, exclusive, non-transferable, and revocable.
- It is installed on a single mobile device (smartphone or tablet), which must have an Internet connection for regular operation, as it utilizes Google Cloud Platform server services. The Application allows generating backup copies of the data extracted from all processed documents, enabling the User to switch devices and restore data on another device.
- It is associated with one of the profiles and one of the plans available in the Application, where each Plan has its own features, benefits, and limitations. In this manner, the User can simultaneously manage the income and expenses of their household/family as well as their businesses or professional, commercial, or productive activities, according to the subscribed profile(s).
- The minimum term of validity for the Use Agreement is one month or thirty (30) calendar days, defining the period in which documents with an issue date within this window may be processed in the Application. Conversely, documents with an issue date outside the term of validity of the Application's Use Agreement cannot be processed. The User may renew the agreement for additional periods of up to twelve (12) consecutive months, or for shorter periods, whether consecutive or not.
- Late Processing of Documents: If, upon chronological expiration of the Use Agreement's term, the User still has an available document quota remaining from that period, they may process additional documents in the Application under the corresponding profile, provided that the document's issue date falls within the term of validity of the expired agreement.
-
Profiles: The Application enables a User with a single Gmail account to simultaneously manage income and expenses for their household/family as well as their businesses or professional, commercial, or productive activities through multiple enabled profiles (each featuring a distinctive icon displayed at the top of the Application). Each profile provides distinct Categories and Subcategories for classifying income and expenses, including:
- Builder: To track income and expenses related to civil construction activities, also including services such as renovations, remodeling, maintenance, and repairs for any type of building; consulting services in construction, architecture, or structural design; rental, sale, or transportation of construction machinery or equipment; and sale of construction materials.
- Merchant: To track income and expenses related to the purchase and sale of any product or merchandise, as well as logistics and freight services for products or merchandise.
- Family: To track the income and expenses of your household or family.
- Farmer: To track income and expenses of the productive and commercial operations of an agricultural or livestock unit.
-
Unit Name: Each Profile is associated with a Unit Name, which is a text identifier that helps the User recognize which Profile they are currently working in (displayed as a watermark on the main screen). This name also appears in reports generated within the Application and across shared content.
-
Categories (Classification Scheme): Within the Application, each Profile defines an income or expense classification scheme aligned with the nature, naming, or semantics of items or line items in the document. Category and Subcategory names are predefined and cannot be modified by the User; they are designed to streamline the organization of accounts and income or expense reporting:
- General Category (Level 1): Establishes the main categories of the Profile, which are semantically mutually exclusive.
- General Subcategory (Level 2): Groups subcategories directly related to and dependent on the selected General Category, which are mutually exclusive of each other. The User manually classifies documents by assigning Levels 1 and 2.
-
Expense Center: A designation or concept within a personal/family budget or a commercial, professional, or productive operation that serves as a general grouping or classification criterion to which income or expenses are assigned, thereby facilitating better control over expenditures, income, or profits. Each Profile includes a default Expense Center that cannot be deleted, but may be renamed. Depending on the subscribed Profile and Plan, the User may create and manage custom Expense Centers.
-
Documents: The Application processes documentary evidence of the User's income or expenses, whether printed receipts (captured via the mobile device camera) or digital files in PDF or image formats ('png', 'jpg', 'jpeg'). Documents substantiate the purchase or sale of goods and services, bank transfers, or employment/professional earnings:
-
Invoices/Orders: From which general data (date, issuer, total amount, taxes, address) and itemized lists of line items or products are extracted.
-
Payment Receipts/Transfer Confirmations: Associated with bank transfers or third-party payments, from which the date, payee, and total amount are extracted.
-
Payroll / Professional Fees (applicable only to the Family Profile): Proof of employment or professional compensation. The Application extracts gross income and can automatically generate secondary sub-documents (derived from the original document) to classify deductions and withholdings into their corresponding Categories and Subcategories.
Additionally, regarding documents:
- Quality and Legibility Requirements: To be validly processed, documents must have an identifiable issue date and a legible total amount. Damaged, crumpled, unreadable documents, or those with unclear data cannot be processed and will trigger an error notification.
- Confidentiality: Processed documents are stored in a subfolder inside the Application folder in the User's Google Drive®, which is the exclusive property of the User. The User is solely responsible for managing and safeguarding all documents and files.
-
-
Plans and Processing Quotas: The MoneyTracky website details the available Plans for each Profile. Each Plan defines:
- The maximum number of Expense Centers that can be created and kept active simultaneously for a Profile.
- The maximum number of documents that can be processed during a one-month (or 30 consecutive days) period for each Profile, a quota that is NOT cumulative for subsequent months.
- Inalterable Quota Accounting: Each document processed through the Artificial Intelligence models permanently consumes one unit of the purchased Plan's monthly quota. The subsequent deletion of the document by the User, its reassignment, or its detection as a duplicate document does NOT restore, deduct, or refund documents back to the consumed quota.
-
Backups: Compressed archive files generated from within the Application containing the device's local database and the data extracted from the User's documents, stored privately in the 'backup' subfolder of the User's Google Drive®. These backups allow the User to recover and migrate data in the event of device replacement, loss, or formatting. The User is strongly advised to generate backups regularly to prevent data loss.
-
Data Extraction: Refers to both the optical character recognition (OCR) process and the extraction of data (utilizing Google®'s Gemini® Artificial Intelligence tool) based on the nature of relevant fields (such as merchant names, dates, totals, taxes, quantities, unit prices, and total values of individual line items) from the documents processed by the User.
-
Gemini: Google®'s tool providing various Large Language Models (LLMs) that perform diverse Artificial Intelligence tasks, including data extraction of relevant fields from document image files.
-
FACTORS AFFECTING DATA ACCURACY AND DISCLAIMER OF WARRANTIES: The accuracy of extracted information depends on technical variables beyond the Company's control, such as: the technical specifications of the mobile device camera, lighting, resolution, creases or physical degradation of the document, and character clarity. THE COMPANY DOES NOT WARRANT THAT DATA EXTRACTION WILL BE ENTIRELY FREE OF ERRORS, DISCREPANCIES, OR INACCURACIES. The User is solely responsible for reviewing, checking, and verifying the veracity of numerical figures before relying on them for personal analysis or deciding to use them for tax filings or official reporting.
-
Third Parties: Refers to individuals or vendors receiving bank transfers or payments for goods or services who do not issue a formal invoice supporting the transaction.
3. DESCRIPTION OF THE SERVICE, SCOPE, AND AVAILABILITY
-
Purpose: MoneyTracky is a service accessed by downloading and installing the application on a mobile device (smartphone or tablet) and purchasing a Plan for a specific Profile. Its purpose is to facilitate the recording of income and expenses through automated data extraction from documents following prior classification into 'Expense Centers,' 'Categories,' and 'Subcategories' (based on the two-level scheme according to the selected profile), enabling monthly tracking of personal or business cash flows and supporting informed financial decision-making.
-
FINANCIAL AND ACCOUNTING DISCLAIMER: The service is strictly a software tool for recording, automated data extraction, and organization of personal or business income and expenses. MONEYTRACKY DOES NOT PROVIDE NOR CONSTITUTE UNDER ANY CIRCUMSTANCES PROFESSIONAL FINANCIAL, TAX, FISCAL, LEGAL, BANKING, OR ACCOUNTING ADVICE. Projections, categorizations, and reports are intended solely for operational and administrative reference. Nevertheless, the service helps eliminate manual, line-by-line data entry, and exporting data can expedite financial or tax analysis and reporting performed directly by the User or with professional advisors.
-
Scope: The Application is authorized solely for purchase and use by individuals residing or domiciled in the United States of America (U.S.) and the Republic of Colombia. The Company reserves the right to suspend requests or access originating from jurisdictions other than those specified.
-
Availability: The Application utilizes tools provided by Google®, including Gmail®, Drive®, Gemini®, and other services in the Google Cloud Platform ecosystem; consequently, operation and availability directly depend on the uptime and response latencies of these platforms. The Company will make commercially reasonable efforts to restore service availability and mitigate installation or operational issues resulting from maintenance, updates, or emergencies, except in cases of force majeure.
-
Artificial Intelligence Resources: The Application incorporates two artificial intelligence tools through which the User can perform queries via natural language prompts, voice dictation (requiring temporary microphone access permissions for predetermined durations in the Application), or typed text. Use of these resources is subject to fair use policies (Fair Use) and infrastructure computing quotas.
-
"AI Query": Provides answers to User inquiries regarding data extracted from processed documents. Generated reports, tables, or results can be exported to PDF, CSV, XLSX, or PNG files, which can be shared via other applications on the device such as email, WhatsApp, etc.
-
AI Assistant: Provides guidance to the User on Application features and can suggest suitable Categories and Subcategories to classify an expense or income item, based on the profile under which a document is being processed.
-
-
Data Resynchronization and Latency Discrepancies: Due to concurrency and asynchronous communication between the User's mobile device and Google Cloud Platform cloud services, temporary discrepancies may occur in consolidated figures across the main screen tables (Balance, Income, Expenses, Taxes). The Application provides a "Data Resynchronization" tool to recalculate and refresh consolidated balances, and such temporary discrepancies do not constitute a breach of contract or definitive Service failure.
4. REGISTRATION, AUTHENTICATION, DRIVE ENVIRONMENT, AND BACKUP REQUIREMENTS
-
Google® Account: To use the Service, the User must authenticate via a personal Google® '@gmail.com' email account. The User is solely responsible for maintaining the confidentiality and control of their password.
-
Google Drive® Connection, Folder Structure, and Storage Space: MoneyTracky organizes and stores processed document images, backups, and reports in subfolders located inside a primary folder named 'MoneyTracky' in the User's Google Drive® account.
- Obligation Not to Alter: The User expressly agrees not to modify, rename, move, or delete the Application's primary folder, subfolders, or configuration files in Google Drive®. Any manual tampering may desynchronize the Application or cause irreversible processing failures, fully exempting the Company from liability.
- Storage Availability: The User is solely responsible for maintaining adequate available storage space in their Google Drive® account. If storage capacity is exhausted, the Application will be unable to store images or process new documents.
-
Custody of Backups and Device Replacement: The local database resides in the internal storage of the User's mobile device.
- Generating periodic backups to Google Drive® is the sole responsibility of the User to protect their data against damage, loss, theft, hardware resets, or device upgrades.
- The Company does not retain copies of the User's local databases on Internet servers. Uninstalling the Application or replacing the mobile device without a prior backup generated in Google Drive® will result in the permanent, irreversible loss of local historical data, without liability to the Company.
- Restoring a backup on a mobile device replaces and overwrites the local data previously stored on that device.
-
Collection of Usage Metadata: The Company may use limited metadata (file name, type of document processed, date, digital/printed format) from User-processed documents in accordance with applicable laws and regulations to generate consolidated usage metrics across profiles, evaluate enhancements, develop new features, and optimize the technological infrastructure supporting the Application.
-
Optional Automation via Google Apps Script: The Application provides an optional script enabling the User to configure automated workflows in their Google Apps Script environment to detect invoices received in their Gmail® inbox and transfer them directly to the Google Drive® processing folder. This script runs entirely under the User's credentials, permissions, and private Google infrastructure. The Company does not access the User's inbox or store private correspondence on its servers.
-
Legal Capacity and Minimum Age: The Service is strictly intended for individuals who are at least 18 years of age.
5. SUBSCRIPTIONS, FEES, AND PAYMENT TERMS
- Plans: The Service is offered through various subscription tiers (e.g., Freemium, Basic, Premium, and Ultra), the specific terms and features of which are published at www.moneytracky.com. By subscribing to a Plan, the User accepts its designated capacity and time limits. Published pricing does not include applicable taxes (such as sales tax, VAT, or similar local taxes depending on jurisdiction) unless explicitly stated otherwise. The User is solely responsible for paying all applicable taxes associated with their subscription.
- Payment Processing: Transactions are processed through secure platforms compliant with the PCI-DSS standard (e.g., Google Play Billing, Apple App Store, or authorized payment gateways in Colombia or the U.S.). The Company does not store full banking or credit card details.
- Specific Terms for the United States: Subscriptions renew automatically (for identical terms, with prior User authorization) at the end of the contractual billing cycle unless canceled by the User before the renewal cutoff date via account settings or the respective app store.
- Specific Terms for Colombia: The statutory right of withdrawal (derecho de retracto) under Article 47 of Law 1480 of 2011 (Consumer Protection Statute) applies within five (5) business days following the initial purchase, provided that:
- The Service has not been substantially consumed—defined as having processed no more than 50% of the purchased Plan's document quota—in which case any refund will follow the calculation set forth in these Terms.
- No breach of the conduct prohibitions stipulated in these Terms has occurred.
6. INTELLECTUAL PROPERTY, USER CONDUCT, AND PROHIBITIONS
-
The Company holds all copyright and intellectual property rights in:
-
The processes, architecture, and UI/UX used to process, organize, and display income and expense information extracted from printed receipts or digital files.
-
The source code of the Mobile Application, data extraction algorithms, and application architecture designed to interact with services in the GCP environment.
The Application claims NO intellectual property rights over any Google® ecosystem services or Gemini® models.
-
-
The User agrees to respect the intellectual property of the Application and expressly agrees:
- NOT to tamper with or improperly manipulate system folders generated by the Application in Google Drive® in an attempt to circumvent quotas or corrupt processing logs.
- NOT to permit third parties to exploit information obtained via Company Services—whether in original or altered form—for commercial gain through copying, broadcasting, editing, publishing, displaying, distributing, disseminating, or creating derivative works.
- NOT to reverse engineer, decompile, web-scrape, or extract automated data from the mobile application, nor use the platform or its contents to train proprietary or third-party Artificial Intelligence (AI) models.
- NOT to deploy bots, scrapers, or unauthorized automated mechanisms to query servers or exhaust infrastructure AI token limits.
- NOT to abuse voice dictation, 'AI Assistant', or 'AI Query' features with automated high-volume queries exceeding reasonable personal use, nor attempt to reverse-engineer, prompt-inject, or extract the underlying model instructions and prompts.
- NOT to process counterfeit vouchers, fraudulent receipts, or documents violating anti-money laundering regulations or third-party legal rights.
- NOT to resell, rent, or share Service credentials with third parties.
-
The User agrees to defend, indemnify, and hold harmless the Company against any damages, losses, claims, or liabilities arising from any violation of these Terms, misuse of the Service, or infringement of applicable laws or third-party rights, including intellectual property.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by the applicable laws of Colombia and the United States:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT EXPRESS OR IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR OF INFALLIBLE MATHEMATICAL OR TAX ACCURACY.
- IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, FISCAL PENALTIES, OR DATA LOSS EXPERIENCED BY THE USER.
- THE COMPANY'S AGGREGATE FINANCIAL LIABILITY FOR ALL CLAIMS RELATING TO THE USE OF MONEYTRACKY SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY THE USER TO THE COMPANY OVER THE PRECEDING THREE (3) MONTHS OF SUBSCRIPTION, OR FIFTY UNITED STATES DOLLARS (USD $50), WHICHEVER IS GREATER.
8. GOVERNING LAW AND JURISDICTION
- For Users Residing in Colombia: These Terms shall be governed by and construed under the laws of the Republic of Colombia, specifically the Commercial Code and Law 1480 of 2011. Any dispute shall preferably be submitted before the administrative authorities of the Superintendence of Industry and Commerce (SIC) or the ordinary courts of the Republic of Colombia.
- For Users Residing in the United States (Dispute Resolution):
These Terms shall be construed under the general principles of United States commercial contract law and the laws of the State of Delaware, without regard to conflict-of-law principles.
- Individual Arbitration Clause: Any dispute arising out of or relating to these Terms or the use of the Service shall be resolved through binding, individual arbitration administered under the rules of the American Arbitration Association (AAA).
- Class Action Waiver: You and the Company agree that any dispute resolution proceedings will be conducted exclusively on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative proceeding.
9. SUSPENSION, CANCELLATION, REFUNDS, AND AMENDMENTS
-
Suspension or Account Termination: The Company reserves the right to suspend or revoke access to MoneyTracky upon detecting violations of these Terms or fraudulent activity. In such an event, the User will be barred from re-registering for one year. If the Company restricts access to the Services, it will notify the User of:
- The grounds for the restriction.
- The scope and details of the restriction.
- The applicable appeals procedure.
-
Service Cancellation: The User may cancel the Service at any time. Upon cancellation, document processing services will be terminated immediately; stored usage logs will be retained and subsequently deleted pursuant to the Privacy Policy. Files stored within the User's Google Drive® folder remain under the User's exclusive control at all times.
-
Refunds: The Use Agreement covers a defined time duration and a quota cap of documents and Expense Centers according to the contracted Plan. If the User requests a refund (where permitted by applicable law), the refundable balance will consider both elapsed time and consumed resources. Two percentage values will be calculated:
- (a) The percentage of days elapsed since the start of the current billing cycle relative to the total days in the cycle.
- (b) The percentage of documents processed relative to the total document quota allocated to the current plan. For purposes of this calculation, every document processed by the AI is permanently counted, regardless of whether it was subsequently deleted by the User or identified as a duplicate.
The higher of percentage (a) or (b) will be deducted from 100%, and the remaining percentage will be multiplied by the amount paid for the current billing cycle to calculate the refundable sum. If the term of validity of the Use Agreement expires without the User having processed or uploaded any documents, this does not constitute grounds for nor entitle the User to any refund.
-
Amendments to the Terms: The Company may update these Terms periodically. Any material modifications will be communicated via the Application or by email notification to the registered address at least fifteen (15) days in advance. Continued use of the Service past the effective date constitutes full acceptance of the revised Terms. The Company reserves the right to modify, update, suspend, or discontinue, temporarily or permanently, any feature or capability of the Service at any time.
